1. Approve the attached Regulations on state fire supervision.

2. Establish a maximum number of employees of the federal fire service performing the functions of state fire supervision at 21,110 units.

3. The Ministry of the Russian Federation for Civil Defense, Emergency Situations and Disaster Relief, together with the interested federal executive authorities, shall submit, within 3 months, to the Government of the Russian Federation a draft federal law on amending the Code of the Russian Federation on Administrative Offenses in terms of clarification list of officials of state fire supervision authorities.

on state fire supervision

1. In order to ensure fire safety in the Russian Federation, officials of state fire supervision bodies of the federal fire service (hereinafter referred to as state fire supervision bodies), who are state fire supervision inspectors, in the manner established by the legislation of the Russian Federation, carry out activities to verify compliance with federal bodies executive authorities, executive authorities of constituent entities of the Russian Federation, local government bodies, legal entities and individual entrepreneurs (hereinafter referred to as organizations), citizens of the Russian Federation, foreign citizens and stateless persons (hereinafter referred to as citizens), as well as officials of fire safety requirements.

2. The main task of state fire supervision is to carry out, in the manner established by the legislation of the Russian Federation, activities to verify compliance by organizations and citizens with fire safety requirements and take measures based on the results of this inspection.

3. State fire supervision bodies include:

1) a structural unit of the central apparatus of the Ministry of the Russian Federation for Civil Defense, Emergencies and Disaster Relief, whose jurisdiction includes issues of organizing and implementing state fire supervision;

2) structural divisions of the territorial bodies of the Ministry of the Russian Federation for Civil Defense, Emergency Situations and Disaster Relief - regional centers for civil defense, emergency situations and disaster relief, the scope of which includes issues of organizing and implementing state fire supervision;

3) structural divisions of territorial bodies of the Ministry of the Russian Federation for Civil Defense, Emergency Situations and Disaster Relief - bodies specially authorized to solve civil defense problems and tasks for the prevention and liquidation of emergency situations in the constituent entities of the Russian Federation, whose jurisdiction includes organizational issues and implementation of state fire supervision, and their territorial departments (branches, inspections);

4) departments (departments, inspections, groups) of state fire supervision of units of the federal fire service, created for the purpose of organizing the prevention and extinguishing of fires in closed administrative-territorial entities.

4. The activities of state fire supervision bodies are carried out on the basis of subordination of lower state fire supervision bodies to higher ones.

5. State fire supervision bodies are guided in their activities by the Constitution of the Russian Federation, federal constitutional laws, federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation, international treaties of the Russian Federation, regulatory legal acts of the Ministry of the Russian Federation for Civil Defense, Emergency Situations and Liquidation consequences of natural disasters, as well as these Regulations.

6. State fire inspection bodies, within their competence:

1) organize and carry out supervision of compliance with fire safety requirements by federal executive authorities, executive authorities of constituent entities of the Russian Federation, local government bodies, organizations, as well as officials and citizens;

2) conduct investigations in cases of fires and cases of violations of fire safety requirements in accordance with the legislation of the Russian Federation;

3) conduct, in accordance with the established procedure, proceedings on cases of administrative offenses in the field of fire safety;

4) carry out official statistical recording and maintenance of state statistical reporting on fires and their consequences;

5) identify officials of state fire supervision bodies to carry out supervision activities;

6) interact with federal executive authorities, including state control (supervision) authorities, executive authorities of constituent entities of the Russian Federation, local government bodies, public associations and organizations, on issues of ensuring fire safety;

7) consider appeals and complaints from citizens and organizations regarding fire safety issues.

7. State fire inspection bodies have seals with the image of the State Emblem of the Russian Federation, stamps and forms of the established form with their name.

8. The following state fire inspectors have the right to carry out activities on behalf of state fire supervision authorities:

1) the chief state inspector of the Russian Federation for fire supervision - the chief state inspector of the Russian Federation for fire supervision, enjoying the rights of the Deputy Minister of the Russian Federation for Civil Defense, Emergency Situations and Disaster Relief;

2) deputy chief state inspector of the Russian Federation for fire supervision - the head of the structural unit of the central apparatus of the Ministry of the Russian Federation for Civil Defense, Emergencies and Disaster Relief, whose jurisdiction includes issues of organizing and implementing state fire supervision, and his deputies;

3) state inspectors of the Russian Federation for fire supervision - employees of a structural unit of the central apparatus of the Ministry of the Russian Federation for Civil Defense, Emergencies and Disaster Relief, whose jurisdiction includes issues of organizing and implementing state fire supervision, employees of structural units of territorial bodies of the Ministry Russian Federation for civil defense, emergency situations and disaster mitigation - regional centers for civil defense, emergency situations and disaster mitigation, whose jurisdiction includes issues of organizing and implementing state fire supervision;

4) chief state inspectors of the constituent entities of the Russian Federation for fire supervision and their deputies - respectively, heads of structural divisions of territorial bodies of the Ministry of the Russian Federation for Civil Defense, Emergency Situations and Disaster Relief - bodies specially authorized to solve civil defense problems and tasks of prevention and liquidation of emergency situations in the constituent entities of the Russian Federation, the scope of which includes issues of organizing and implementing state fire supervision, and their deputies;

5) state inspectors of the constituent entities of the Russian Federation for fire supervision - employees of structural divisions of territorial bodies of the Ministry of the Russian Federation for Civil Defense, Emergency Situations and Disaster Relief - bodies specially authorized to solve civil defense tasks and tasks for the prevention and liquidation of emergency situations in the constituent entities the Russian Federation, whose jurisdiction includes issues of organizing and implementing state fire supervision;

6) chief state inspectors of closed administrative-territorial entities for fire supervision and their deputies - respectively, heads of departments (divisions, inspections, groups) of state fire supervision of units of the federal fire service created for the purpose of organizing the prevention and extinguishing of fires in closed administrative-territorial entities, and their deputies;

7) state inspectors of closed administrative-territorial entities for fire supervision - employees of departments (divisions, inspections, groups) of state fire supervision of units of the federal fire service created for the purpose of organizing the prevention and extinguishing of fires in closed administrative-territorial entities;

8) chief state inspectors of cities (districts) of the constituent entities of the Russian Federation for fire supervision and their deputies - respectively, heads of territorial departments (branches, inspections) of structural divisions of territorial bodies of the Ministry of the Russian Federation for Civil Defense, Emergency Situations and Disaster Relief - bodies, specially authorized to solve civil defense tasks and tasks for the prevention and liquidation of emergency situations in the constituent entities of the Russian Federation, whose jurisdiction includes issues of organizing and implementing state fire supervision, and their deputies;

9) state inspectors of cities (districts) of the constituent entities of the Russian Federation for fire supervision - employees of territorial departments (branches, inspections) of state fire supervision of departments (departments, offices) of structural divisions of territorial bodies of the Ministry of the Russian Federation for Civil Defense, Emergency Situations and Elimination of Consequences of Natural Disasters disasters - bodies specially authorized to solve the problems of civil defense and the tasks of preventing and eliminating emergency situations in the constituent entities of the Russian Federation, the scope of which includes issues of organizing and implementing state fire supervision.

9. State inspectors of cities (districts) of the constituent entities of the Russian Federation for fire supervision and state inspectors of closed administrative-territorial entities for fire supervision have the right:

1) carry out state fire supervision over compliance with fire safety requirements by organizations, as well as officials and citizens;

2) conduct surveys and inspections of territories, buildings, structures, premises of organizations and other facilities, including during non-working hours, in order to monitor compliance with fire safety requirements and suppress their violations;

3) demand the presentation of documents, information, samples (samples) of products if they relate to the subject of inspection;

4) enter freely, in the manner established by the legislation of the Russian Federation, into residential and other premises and land plots of citizens if there is reliable information about a violation of fire safety requirements that creates a threat of fire and (or) a threat to the safety of people;

5) give heads of legal entities and individual entrepreneurs, officials and citizens mandatory instructions to eliminate violations of fire safety requirements;

6) Deleted.

7) stop for a short time, until the case is considered by the court, in the manner established by the legislation of the Russian Federation on administrative offenses, the activities of branches, representative offices, structural divisions of a legal entity, production sites, as well as the operation of units, facilities, buildings or structures, the implementation of certain types of activities ( works), provision of services if this is necessary to prevent an immediate threat of fire and (or) a threat to the life or health of people and if preventing these circumstances by other means is impossible;

10. The chief state inspectors of cities (districts) of the constituent entities of the Russian Federation for fire supervision and their deputies, as well as the chief state inspectors of closed administrative-territorial entities for fire supervision and their deputies enjoy the rights specified in these Regulations, and also have the right:

1) carry out state fire supervision over compliance with fire safety requirements by territorial bodies of federal executive authorities and local government bodies;

2) give heads of legal entities and individual entrepreneurs, officials and citizens mandatory instructions to ensure fire safety in relation to goods (work, services), discontinuation of production, cessation of production and suspension of sales of goods (work, services) that do not meet the requirements fire safety;

3) summon officials and citizens to the state fire supervision authorities in connection with ongoing cases and materials about fires, receive from them the necessary explanations, certificates, documents and copies thereof;

11. State inspectors of the constituent entities of the Russian Federation for fire supervision enjoy the rights specified in this Regulation, and also have the right to review, in accordance with the established procedure, in terms of compliance with fire safety requirements, urban planning and design and estimate documentation for construction, major repairs, reconstruction, expansion and technical re-equipment of organizations, buildings, structures and other objects with justified deviations from current requirements or in the absence of these requirements.

12. The chief state inspectors of the constituent entities of the Russian Federation for fire supervision and their deputies enjoy the rights specified in - 11 of these Regulations, and also have the right:

1) carry out state fire supervision over compliance with fire safety requirements by executive authorities of the constituent entities of the Russian Federation;

2) submit proposals to government bodies of the constituent entities of the Russian Federation on the implementation of fire safety measures in accordance with the legislation of the Russian Federation;

3) submit proposals to the state authorities of the constituent entities of the Russian Federation on the establishment of a special fire safety regime in the territories of the constituent entities of the Russian Federation.

13. State fire supervision inspectors of the Russian Federation enjoy the rights specified in - 12 of these Regulations, and also have the right to exercise state fire supervision over compliance with fire safety requirements by federal executive authorities.

14. The chief state inspector of the Russian Federation for fire supervision and his deputies are vested with the rights established by the legislation of the Russian Federation in full.

15. Officials of state fire inspection bodies are issued appropriate service certificates and official seals. Samples of service certificates and official seals, as well as the procedure for their issuance, are determined by the Ministry of the Russian Federation for Civil Defense, Emergency Situations and Disaster Relief.

16. Officials of state fire supervision authorities are obliged to:

1) timely and fully fulfill the powers granted in accordance with the legislation of the Russian Federation to prevent, identify and suppress violations of fire safety requirements;

2) comply with the legislation of the Russian Federation, the rights and legitimate interests of organizations and citizens;

3) carry out control measures on the basis of and in strict accordance with the orders of the state fire supervision authorities on carrying out control measures in the manner established by the legislation of the Russian Federation;

4) visit the facilities (territories and premises) of organizations for the purpose of carrying out control measures only during the performance of official duties upon presentation of service certificates and orders of state fire supervision authorities to carry out control measures;

5) not prevent representatives of organizations from being present during control activities and providing explanations on issues related to the subjects of their inspections;

6) provide the heads of legal entities and individual entrepreneurs or their representatives present during control activities with the necessary information;

7) acquaint the heads of legal entities and individual entrepreneurs or their representatives with the results of control measures;

8) when determining the measures taken in response to detected violations, take into account the compliance of these measures with the severity of the violations, their potential danger to the life and health of people, the environment and property, and also not allow unreasonable restrictions on the rights and legitimate interests of citizens and organizations;

9) prove the legality of their actions when appealing them in the manner established by the legislation of the Russian Federation;

10) carry out explanatory work on the application of the legislation of the Russian Federation on fire safety during control activities;

11) observe commercial and other secrets protected by law.

17. Officials of state fire supervision bodies are liable for improper performance of their duties in the manner established by the legislation of the Russian Federation.

18. The rights and responsibilities of state fire inspection inspectors may be vested in citizens of the Russian Federation who have a higher or secondary specialized education, who are serving in the Ministry of the Russian Federation for Civil Defense, Emergency Situations and Disaster Relief, certified for compliance with the qualification requirements established Ministry of the Russian Federation for Civil Defense, Emergency Situations and Disaster Relief.

19. Scientific and technical support for the activities of state fire supervision bodies is carried out by fire-technical research and educational institutions subordinate to the Ministry of the Russian Federation for Civil Defense, Emergencies and Disaster Relief, created in the prescribed manner.

By Decree of the Government of the Russian Federation of February 14, 2009 N 124, paragraph 20 of the Regulations was amended

20. Control (supervision) over compliance with fire safety requirements at the facilities of the Ministry of Defense of the Russian Federation, the Federal Security Service of the Russian Federation, the Federal Security Service of the Russian Federation, the Main Directorate of Special Programs of the President of the Russian Federation and the Foreign Intelligence Service of the Russian Federation is carried out in the manner established by the provisions on their departmental fire protection, agreed with the chief state inspector of the Russian Federation for fire supervision.

21. This Regulation does not apply to the procedure for monitoring (supervision) over compliance with fire safety requirements in forests, as well as at underground facilities and during the production, transportation, storage, use and disposal of explosive materials in organizations conducting blasting operations using industrial explosives appointments.

22. Financial and logistical support for state fire inspection bodies is an expenditure obligation of the Russian Federation.
