What is examination of design documentation

Examination of design documentation involves assessing the compliance of project documentation with Russian laws, construction regulations and other necessary conditions. The assessment procedure is permitted to be carried out both by a state institution and by organizations that have the right to conduct a non-state examination of design documentation and (or) a non-state examination of the results of engineering surveys.

Check your partners urgently!

Do you know that When checking, tax authorities can cling to any suspicious fact about the counterparty? Therefore, it is very important to check those with whom you work. Today, you can receive free information about your partner’s past inspections, and most importantly, receive a list of identified violations!

Examination of design and estimate documentation is important to secure real estate. Thanks to it, you will be able to control the level of reliability during operation and the structural safety of the structures being built. In addition, examination of surveys and design documentation verifies the balance between characteristic features architectural graphics, careful use natural resources, material, energy and financial costs.

What are the different types of examination of project documentation?

- Not state examination. Used in working with documents for capital construction, reconstruction of buildings and major renovation real estate - in accordance with Federal Law No. 337 of November 28, 2011.

- State examination. Directed to work with documents for the capital construction of structures, reconstruction and major repairs of quite dangerous, technically difficult to reproduce, unique buildings in accordance with Federal Law No. 337 of November 28, 2011.

– Expertise industrial safety. Used when interacting with documents for technical re-equipment, conservation and elimination of hazardous materials production premises– in accordance with Federal Law No. 116 of July 21, 1997.

For which objects is state examination of design documentation carried out?

State examination of design documentation has been carried out since January 1, 2007. It replaced a complex system of inspections that existed for a long time in our country and was carried out in several stages. The authorized body responsible for its implementation is Rosstroy, or rather, the Federal State Institution “Glavexpertiza of Russia”, which is subordinate to it.

There is a list of objects that undertake to conduct state examination. These are the objects:

– used for the military defense of the state and its security;

– cultural heritage, unique in its kind, and of federal significance;

– technically complex;

– potentially dangerous or classified as “secret”;

– being built in territorial or internal sea waters or on the continental plume;

- being built in a certain economic sphere or on a site that is located in several regions of the country.

Non-state examination of project documentation: who should carry it out

This examination is carried out by government agencies of a specific subject of the Russian Federation that have authority in this matter. Also, this right is granted to organizations that have undergone the confirmation procedure in accordance with Article 50 of the Civil Code of the Russian Federation and received the right to conduct an inspection of this level.

Non-state examination of design documentation is carried out for other structures that do not fall into the group of objects of federal significance. Also this check applies to newly constructed construction projects, for which state examination is not mandatory (see for more details Article 49, clauses 2 and 3 of the Town Planning Code). The conclusion of a non-state examination of project documentation has the same force as the conclusion of a state image tsa and is fully accepted by Rostechnadzor.

Rules for checking the expert level

Andrey Kulagin, CEO Pacific Stroy company, Moscow

To date, we acknowledge that we do not have specific registries disclosing this topic. You can always find information on the Internet. Pay attention to the length of service, experience and reputation of the expert. As practice has shown, among construction experts, choose those who meet the following criteria:

– Higher education in civil and industrial engineering, design and construction, architecture.

– Experience in the field of expert activities for at least 4 years (this can be a foreman or design engineer with higher education, ability to perform construction expertise). Professionals who have been designing for more than 2 years have their own advantages and will make the examination much better. The general experience of construction expertise is not always enough to understand the specifics of a narrower problem.

– A legally competent expert is required, since he is subject to serious responsibility, in some situations even criminal. He has no right to falsify or provide false data, even if these actions are taken in the interests of the customer.

The expert’s communication style should also deserve attention. Professionals should not be overly emotional and unfounded. We contacted the design institute in a private process in 2012. The customer filed a claim against the general contractor. As a result, we proved the inconsistency of the investor’s expert opinion. Having discovered the unprofessional work of the expert on the customer’s side, we debunked all points of the provided expertise. In addition to the above, the expert did not have the right to provide an expert opinion.

When is examination of design and estimate documentation required?

An examination of design and estimate documentation is required when real estate of federal significance and any buildings of constituent entities of the Russian Federation are being built. Projects under construction may have all sorts of ownership options and financing sources.

To conduct this examination, it is necessary to have a feasibility study (feasibility study) for construction.

There is a whole list of official documents submitted for examination of design and estimate documentation. It is regulated by special rules of the Russian Federation and building codes.

When examination of design documentation is not required

    When performing ongoing building repair work.

    Provided that during major repairs and reconstruction there is no need to undergo an examination of the design documentation of real estate. Since it already has the necessary permission from the authorities state power and is used a second time.

According to Part 17 of Art. 51 Civil Code of the Russian Federation, there is no need to obtain consent to conduct construction work, If:

– You are starting to build a garage on land that belongs to a private individual. The intended use of this site is not related to commercial activities, since the use of the land is permitted only for organizing a garden and building a summer house;

– Construction work and reconstruction of buildings are being carried out that are not considered structures falling under the concept of capital construction (kiosks, sheds, etc.);

– When constructing structures for additional use;

– You make changes to objects that are intended for capital construction, or their component sections, provided that they do not affect structural and other quality criteria. Also, the changes made should not be higher than the maximum values that are allowed during construction;

– In other situations, when it is not necessary to obtain consent for construction work, relying on the Town Planning Code, regional laws on town planning activities.

What documents are needed for the examination of project documentation

To organize the examination of project documentation, the following documents are needed:

– description of work by sections of the project;

– feasibility study;

– initial information for design;

– a complete project on the content of the work, for example, drawn up general plan, description of the technological part, methods of automating the process.

What is assessed during the examination of project documentation

1. The reasonableness of the developed process, which describes construction technologies, the measure of its safety and reliability. Checking how correctly they are written technical methods interaction, whether procedures aimed at increasing the safety of planned work are followed;

2. The qualities of the most important fire hazard, toxic properties of the materials used;

3. The optimality of the actions taken with the goal of ensuring the reliability of the structure being built;

4. Fast and reliable way shutdown of individual areas or elements of real estate for emergency and maintenance repairs;

5. The reasonableness of the options used in construction for the location of main and auxiliary equipment;

6. Reliability and correctness of the selected options for the location of the property;

What is the procedure for examining project documentation?

1) Within 1-3 days, a package of documents is collected and assigned a unique number.

2) Payment is made under the contract, which specifies the cost of examination of the design documentation. Then the project goes for review, which lasts about a month.

You in in writing must notify if, during the examination of design documentation and engineering survey results, additional calculations, the introduction of an additional section, or complete revision of other sections are required.

If important documents are missing for the inspection, you will also quickly find out about this by receiving information about the return of documentation.

3) Professionals prepare a report, which is sent to the next body that prepares a comprehensive final conclusion.

4) Within a specified period, identified inconsistencies are eliminated, after which all claims that arise are deleted.

5) Drawing up the final conclusion of the examination of project documentation. As a result, you will receive several copies.

A positive conclusion from the examination of project documentation is usually ready in two to three weeks.

The period for examination of design documentation for residential buildings should not exceed 45 days, for non-residential buildings - 90 days.

If you receive a negative conclusion, insist that you want to re-examine the design documentation.

When is a re-examination of project documentation carried out?

1. When there is a need to develop auxiliary sections;

2. When big changes have occurred in the project;

3. When the design documentation, which previously had a positive conclusion, has been corrected and significant additions have been made to it.

The procedure for organizing and conducting a re-examination is similar to the initial one.

How to calculate the cost of examination of project documentation

Calculation of the examination of project documentation occurs as follows:

Se = Sb*K, where

Se – cost of examination;

Sat – basic cost of examination;

K – inflation coefficient.

Sat = (A+B*X +C*Y)*Kn*Ks,

where A is a permanent fee, which is equal to 100,000 rubles;

B – duty equal to 35 rubles;

C – constant value – 3.5 rubles;

X – area land plot for construction;

Y – area of the object being built;

Kn – coefficient taking into account the type of work performed (construction Kn = 1, repair Kn = 0.5);

Kc is a coefficient that takes into account the complexity of the area for construction:

– in mountainous regions Kc = 1.5;

– seismic areas Kc = 1.2-1.3;

– in other areas Kc = 1.

An online calculator for the examination of project documentation can be found on the SRO websites. With it you can easily calculate all quantities.

  • Current assets of an enterprise: concept, management and analysis

For a repeated state examination of project documentation, you will need to pay 30% of the estimated cost of the first inspection.

It is also possible to undergo this procedure for free, but only when you provide all the necessary documents in a timely manner, within two weeks.

Verification of design documentation is necessary stage, which goes through any project before construction work begins. Receive today expert opinion possible both in state and in commercial organizations. An expert opinion is a guarantee of the safety and quality of the project. Without such a conclusion further implementation design work simply not possible.

Examination of design documentation involves assessing its compliance with technical, sanitary-epidemiological, environmental standards and regulations, as well as fire, industrial, radiation or nuclear safety requirements, and compliance with the rules of state protection of cultural objects.

To simplify the issuance of expert opinions, there are a number of cases when an examination of project documentation is not mandatory or not required at all. Such cases are regulated by the federal legislation of the Russian Federation.

The result of the examination is the issuance of an appropriate conclusion. Such a conclusion can be either positive or negative. The duration of the examination depends on the complexity of the project, but usually it does not exceed three months.

An examination of design documentation is not mandatory in the following cases:

  1. When carrying out repair, reconstruction or modernization work industrial buildings and structures, public or residential buildings, in which the main engineering solutions project documentation will not affect the main load-bearing capacity buildings, structures or structures.
  2. When carrying out reconstruction or repair work on thermal, water supply or sewer networks on existing routes using more modern materials.
  3. When performing current repair work highways, which are in the prescribed manner refer to works on content highways.
  4. Estimate documentation prepared in accordance with the established procedure for carrying out any ongoing repair work.
  5. Estimated documentation with additions and changes that were made in accordance with established requirements or limited costs of work.
  6. Design documentation for the construction of facilities that belong to the third level of responsibility according to technical standards and acts (one-story, two-story residential buildings; temporary, auxiliary and seasonal buildings, such as parking lots, pavilions, warehouses, supports for lighting or communication lines, fencing, etc.; detached objects of the agro-industrial complex with ancillary or auxiliary purpose).
  7. Design documentation for the maintenance of various hydraulic and ship structures and structures, which is necessary to ensure their reliable operation, track work and navigation safety.
  8. Technical documentation for replacement or repair work of industrial, technical and other equipment, machines, mechanisms or units, which is developed and approved by specially authorized bodies in a certain area in accordance with all necessary regulations, and which does not require any construction works
  9. Design and estimate documentation, in which any changes have been made building materials, equipment or products for similar ones and the replacement of which will not affect the main bearing structures.
  10. Design documentation for binding standard projects or projects that are reused for the construction of individual residential buildings or social facilities.

According to federal legislation, design documentation for the following capital construction projects does not require state examination:

  • separate residential buildings with a height of no more than three floors, intended for residence of no more than one family;
  • multi-apartment residential buildings, no higher than three floors, which can consist of no more than four sections with apartments, premises for common use and separate entrances;
  • detached residential buildings, no higher than three storeys, which may consist of no more than ten blocks, each of which is intended for the occupancy of only one family and has one or more common walls without openings;
  • detached non-production facilities that are not intended for citizens’ residence, no more than two floors and with total area no more than 1500 square meters(exceptions are technically complex or dangerous objects);
  • stand-alone production facilities with a height of no more than two floors and a total area of up to 1,500 square meters, for which there is no need to establish sanitary protection zones (with the exception of technically complex or dangerous facilities).

Despite the fact that all of the above cases do not require a strict examination of project documentation and the issuance of an expert opinion, nevertheless, the development of technical, design and estimate documentation is necessary.

- one of the first stages of the capital construction or reconstruction process. We will tell you in our article how to prepare and pass the examination, what to do if the expert opinion turns out to be negative, and other issues related to this procedure.

How does the Urban Planning Code define the examination of design documentation?

The Town Planning Code does not provide a clear definition. However, an analysis of Article 48, devoted to project documentation, and Article 49, covering issues of expert work on the project, allows us to conclude that the examination of project documentation is a special study that determines the compliance of the data and calculations given in the project established standards and rules. This allows you to find out how safe the planned facility is for people and the environment.

In addition, an examination (with a few exceptions) is required for proper documentation future construction and the resulting facility. After all, a positive expert opinion in most cases is included in the list of documents required to obtain a construction permit.

At the same time, the Town Planning Code establishes two options examination of design documentation:

  • state examination;
  • non-state examination.

State examination is carried out by special government agencies authorized to do this. Non-state examination can be carried out in private companies accredited to provide such services. With the exception of a small list of objects planned for development, in respect of which mandatory state examination of project documentation, The Town Planning Code allows the customer to independently choose the option that suits him best.

Passing the examination of design documentation

The order of organization and passage examination of project documentation Decrees of the Government of the Russian Federation No. 145 of March 5, 2007 and No. 272 of March 31, 2012 are devoted to this issue. According to their provisions, the customer must contact a specialized government agency or a private accredited organization with the necessary package of documents.

Examination of design documentation carried out on the basis of an agreement concluded between the customer and the contractor (expert institution). The contract discusses all significant conditions for the provision of services for conducting examination of project documentation, including:

  • timing of work;
  • service cost;
  • rights and obligations of the parties;
  • a set of documents necessary for the examination.

The minimum list of documents (can be submitted both electronically and in paper form) required for the examination of the project includes:

  • application for examination;
  • design documentation;
  • design assignment;
  • a document confirming the authority of the customer’s representative;
  • list of documents.

The result of the examination of project documentation there will be a positive (if the project complies with current norms and rules) or negative (if the project does not comply with current norms and rules or contains comments and inaccuracies) conclusion, which is handed to the customer.

Is examination of project documentation necessary when making changes to the project?

Sometimes after a successful examination of project documentation changes are required to the project. The question naturally arises: is it necessary to repeat this procedure? The Town Planning Code and Resolution No. 145 say in this regard that a re-examination of the revised project is required if:

  1. The amendments affected technical solutions, affecting the structural reliability and safety of the capital construction facility. The list of types of work that affect the safety of capital construction projects is established by order of the Ministry of Regional Development of Russia No. 624 dated December 30, 2009.
  2. The corrections led to an increase in construction estimates.

Re-examination of project documents is carried out in the same order as the initial one. However, in this case, only the corrected part of the project and its compatibility with the rest of the documentation will be analyzed. The only case when it is held expert analysis of all revised project documentation, is to introduce changes to the legislation affecting the results of the initial examination.

What to do if the results of the examination are negative?

If the result of examination of project documentation If there is a negative conclusion, then the customer has two options:

  1. Challenge the conclusion of the expert organization in court or the Ministry of Regional Development.
  2. Eliminate these comments and undergo the examination again.

It must be borne in mind that in practice, it is worth challenging the conclusion of experts in court only if there are sufficient grounds to assume that the analysis was carried out erroneously with a negative conclusion in the end. Otherwise, challenging the examination in court will be a long, costly and useless undertaking.

The second option may be more effective, since it only requires corrections to the specified comments. Moreover, if changes can be made to the project without returning the documentation, the expert organization has the right not to return the project on paper to the applicant. The customer is in fixed time eliminates the comments, and then presents to the experts that part of the project that has been edited, and a certificate of the adjustments made.

The nuances of conducting an examination of project documentation in a non-state form

If examination of project documentation decided to be carried out in a non-state form, it is very important to check the powers of the performing organization regarding the performance of expert work of this kind before concluding a contract.

The right to conduct examinations is given by accreditation, which is confirmed by a certificate issued by the Federal Accreditation Service (Rosaccreditation). The certificate must contain:

  • data from the organization providing project review services;
  • a list of types of expert work for which the company is accredited;
  • seal of the Federal Agency for Accreditation and signature of the official.

At the time of the examination, the accreditation certificate must be valid (i.e. not expired). In addition to documentary confirmation, the presence of accreditation can be checked through the website of the Federal Agency for Accreditation - http://fsa.gov.ru, by finding the organization of interest in the register of legal entities accredited for the right to conduct non-state examination of project documentation.
