Using a bank card for payments is usually more convenient than carrying around a wad of banknotes and a handful of small change, but do not forget that not only cash, but also money from a card account can be stolen.

In accordance with Part 12 of Art. 9 of the Federal Law of June 27, 2011 No. 161-FZ " " the bank is obliged to return money written off from the card without the client’s consent. However, this rule only applies if the reason for writing off the money is not a violation of the rules for using the card by the client himself. Another condition necessary for a refund is that the client must notify the bank about the incident no later than the day following the day of receiving notification of the transaction from the bank. The method of informing the client about transactions with a bank card is agreed upon by the bank and the client in the agreement, and the bank is obliged to provide a free method of such information. However, this could be, for example, posting relevant information in the client’s personal account on the bank’s website, sending an email, etc. It can be difficult to find out in a timely manner about the theft of money in such a situation. Therefore, you should carefully study the agreement with the bank and, if necessary, sign up for an SMS notification service about card transactions. It should be remembered that every second that passes from the moment of theft of money from a bank card reduces the likelihood of its return, and crimes are best solved without delay.

  • immediately report the theft by phone to the bank and demand to block the card (the remaining funds on the card account can be obtained at a bank branch even if the card is blocked) or block the card in your personal account yourself;
  • report theft to the police by phone or in person;
  • no later than the day following the day of receipt from the bank of a notice of debiting money, arrive at the bank branch and submit a written notification of the theft and blocking of the card account.

Almost every person has used a payment instrument such as a bank card once in their life. But not many people know that the card needs to be additionally protected. After all, with the development of technology, scammers do not stand still. There are many variations of malicious actions. Below we will look at ways to steal money from a card.

Fraudsters are becoming more sophisticated every time. There are already more than a dozen different ways to receive funds from cards of other owners. And the bank cannot protect its clients from such actions in any way.

Currently, scammers have come up with many ways to steal money from a card.

skimming

This is a common procedure that existed initially, as soon as bank cards appeared on the financial market. A special reader is attached to the ATM card reader, which helps remember the combination entered by the client. By pressing the PIN code on such a device, a person is unaware that he is communicating secret information to other people.

It is also common to attach a small camera that reads all human actions. Using the procedure, you can read all the information from the payment system. Then the scammers make similar plastic with the read data. And then it remains a matter of cashing out funds.

Therefore, the cardholder must check for such details when withdrawing cash from an ATM. Experts also advise cashing out through official branches of the lender or in shopping centers.

Phishing is a computer crime that is used to obtain the same information when entering a bank’s personal account. Attackers use spam and steal client information. Using this method you can get a PIN code, account number and passwords. This is not receiving cash, this is an opportunity for scammers to pay for goods and services remotely.

Shimming is a type of skimming. In this case, it is not a camera that is used, but a flexible board. But fraud is carried out in a similar way.

Installation of fake ATMs

This is a fairly rare occurrence that allows fraudsters to obtain not only funds, but also information about all the cards that were in the ATM. But installed fake terminals are not uncommon. And in the vastness of Russia they appear more and more often. Externally, it is impossible to distinguish a fake from the original.

Inside, the terminal is empty and contains only a reader for further fraudulent activities. Now, attackers have begun installing a specialized bus on the ATM. Once the information is received, the process is terminated. Next, a connection occurs with a fake electrical device, which can give a command to cash out in another region.

Terminals are attacked

You can get a solid reward not through an ATM, but through a terminal. After all, several thousand pass through it every day. These are electronic devices installed in shopping centers and train stations to pay for mobile phones and housing and communal services.

Theft of personal information is carried out through the installation of harmful software or other details. Special code finds various loopholes to obtain customer data.

Payment for services in a restaurant

It is often found that a restaurant does not have a portable POS terminal. And the waiters take away the payment instrument to carry out the transaction. Employees can also take advantage of the provision and make a copy of the card data, and then use the information on a specialized exchange.

You should not give the instrument into the hands of strangers. It's better to go to the counter and pay yourself.

When entering your PIN code, cover the panel with your hand

Questionable application

You can transfer such data to obtain a loan from dubious organizations. Therefore, experts recommend not downloading dubious applications onto your phone.

Open Wi-Fi

The most active and fastest way to obtain information about a bank card is open Wi-Fi. The clientLogin protocol is often used to steal information. If a smartphone automatically connects to any open network, it can be intercepted. And then scammers will be able to use all the entered data.

You should not connect to public networks in cafes or subways.

SMS message

Almost every bank card owner received messages when a person urgently asked for help and transferred funds to him. You also receive a message on social networks asking you to provide information about your payment instrument to carry out a transaction.

This type of action is not worth doing. It is necessary to urgently contact the citizen from whom the notification comes and specify this fact.

Other methods

NFC (“near field communication”) is another method of obtaining information fraudulently. There are certain mobile phone applications that read information from a payment instrument using radio communication. At the same time, applications are considered legal, like Banking Card.

If a person pays with an application, then he can touch someone else’s wallet. And it may have a reader that can find out all the information about the card, except the CVV code. But the information received is enough to make a purchase online.

There are also fake sites for lenders and payment systems on the Internet. Often a message is sent to your registered email indicating that you have won. Therefore, many cardholders agree to this condition. In this case, you can receive your winnings only by entering the card number, owner’s full name and expiration date.

Responsibility and return

How to steal money from a card is a question many owners of payment instruments ask. Theft from a bank card is carried out using various methods applicable in a given situation.
The bank does not bear any responsibility for the actions of fraudsters. Specialists do not distribute confidential information to third parties. Therefore, the owner of the plastic is responsible for all intentional actions of criminals.

It is almost impossible to get your money back. This type of fraud is no different from the standard one. It is possible to protect yourself from such actions, but if you adhere to the approximate capabilities of surfing the Internet, and also use an antivirus.

There is no need to go to dubious sites using links. It’s better to go to your personal account and view all the necessary information. Also, do not enter sensitive data on the site. Banking institutions always stipulate that no one asks the client to provide confidential information.

It often happens that your smartphone receives an SMS about a transaction, but after checking the balance there is no money on the card. This is another type of fraud that has become increasingly widespread lately. That is, the fraudster initially transfers funds to the number attached to the card, and then to his account.

This fraudulent scheme became available when the SIM card was counterfeited or disabled.

There are many dubious applications that steal user data

Evidence or insurance

It is quite difficult to prove the withdrawal of funds by fraudsters, but it is possible. This action should not be ignored. You should act according to the following algorithm:

  • with your passport, go to a credit institution, where you need to write a statement of disagreement with the transaction;
  • contacting law enforcement agencies;
  • clarification of information about calls and messages from cellular communications.

Some credit institutions offer some protection for your funds on a payment instrument for a certain fee. At Sberbank, the method has been officially developed and allows you not to be afraid of theft due to the insurance product. Protection is provided against insurance situations:

  • use of the tool by a third party;
  • theft of a payment instrument, PIN code or withdrawal of funds;
  • phishing and shimming;
  • damage to plastic;
  • theft of money after withdrawing cash from a lender's branch or ATM;
  • from various technical failures and damage to the electronic device.

Insurance protection is provided in three variations in the amount of 30, 120 and 250 thousand rubles. The cost of the insurance policy annually is 700/1710/3510 rubles. respectively.

Purchasing an insurance product is the only way to protect yourself from various financial frauds. The cost of the policy is directly equal to the amount of coverage.

Fraudulent actions related to finances are punishable under Article 159.3 of the Criminal Code. Based on this legal act, all transactions with bank cards are also considered a crime. For this crime, the offender faces a significant fine or arrest, as well as correctional labor or restriction of freedom.

Reimbursement in monetary terms or the possibility of employment depends on the amount withdrawn, as well as the possibility of committing fraud independently or by a specific group.

How do they steal? Thousands of people ask this question. And many are already afraid to open payment instruments. You can withdraw an amount from the cards and store it at home, but this will not allow you to fully take advantage of the banking service and receive additional income.

An 18-year-old waitress from a Moscow restaurant took photographs of customers’ cards and, using their data - full name, card number, expiration date and CVV/CVC code, paid for her purchases in online stores. This is one of the last, but far from the only cases. Judging by the news feeds of Russian and regional media, almost every day at least one Russian faces a similar problem - theft of money from a bank card. Sravni.ru provides instructions on how to return funds stolen by scammers.

To whom will the bank definitely return the money?

By law, the bank is obliged to return to the client the money illegally debited by fraudsters from his card, subject to both conditions being met:

  • the client did not violate the rules for safe use of the card;
  • the client notified the bank about the unauthorized transaction no later than one day after receiving notification from the bank about such transaction.

But all this will fade into the background if the bank itself has not informed the client about the operation. The fact is that the bank is obliged to notify customers free of charge about any card transactions; the method of notification is specified in the contract (this can be SMS notifications, emails, information via Internet banking, etc.). If this condition is violated, the credit institution is obliged to compensate its client for losses in full.

What to do if money is missing from the card?

As the head of the VTB 24 plastic cards department, Alexander Borodkin, told Sravni.ru, it is impossible to cancel an unauthorized transaction, but it is often possible to return funds to the client. It is only important to react quickly.

And you can do this as follows:

Step one. Urgently call the bank (the phone number is indicated on the back of the bank card and on the official website of the credit card), report the unauthorized debiting of money and block the card. Fraudsters can try again and steal from the card again.

Step two. Write an application to the bank to protest the unauthorized transaction. But you should hurry - you must have time to leave a claim within the day following the day when the fraud became known.

According to Borodkin, this can be done by phone or in a branch, depending on each specific bank.

You can find out whether the bank accepts claims over the phone or whether a written application from the client is required, left directly at the bank’s office, from the operator of the credit institution’s call center, through whom the card was blocked.

But many experts still advise coming to the bank in person so that the cardholder has a certified copy of his application (the bank employee must put a mark on it that the application has been accepted). It will come in handy if the case goes to trial.

Step three. Immediately contact the police and file a report of fraudulent activity.

Step four. Wait for the results of the bank's investigation and the return of the money.

How long will it take for the bank to return the money?

The question is complex. The bank is obliged to consider the client’s claim within 30 days, but the terms for returning money are not specified in the law. In some cases, clients have to wait only a few days, in others – several months.

“The process is lengthy and takes from one to several months. Don’t forget that in addition to the bank and the payment system, law enforcement agencies also participate in it, opening a criminal case, searching for criminals, taking the case to court, etc.,” explains Alexander Borodkin.

In what case may the bank not return the money?

If a bank refuses to compensate a client for stolen funds, it means that it has evidence that the client himself is to blame for this. And this is not at all about the fact that the card owner himself was in collusion with the scammers, he simply violated the rules for the safe use of a bank card. For example, scammers called him and, posing as bank employees, “fished out” confidential information: login and password for logging into the Internet bank, password that came via SMS, CVC code, PIN code, etc. Or, say, the client lost the card, but did not notify the bank and did not block it.

Another reason for refusal is that the client violated the deadline and did not submit a statement to the bank about theft of money from the card within the day allotted to him by law after the fact of fraud became known).

What to do if the bank refused to return the money?

Go to court and challenge the decision of the bank and payment system.

How to protect your card from fraudsters?

“Put it in the safe and never take it out. But seriously, there are a huge number of security enhancements for using the card (chip on the card/SMS notifications/3D security, etc.), there are tools for 100% return of stolen amounts (insurance), there are tools for limiting the amount of spending (card limits) . And many other tools that you should check with your issuing bank,” recommends the head of the VTB 24 plastic cards department.

Tips Compare.ru:

  • do not disclose confidential data to anyone (PIN code, information for logging into online banking, passwords for confirming transactions that come via SMS);
  • do not respond to SMS or call back the number specified in the message if they ask for personal information on the card or they come from a number different from the one the bank usually writes to you from;
  • install an antivirus on the computer from which you log into the Internet bank and update it regularly;
  • cover the keyboard with your hand when entering your PIN code at an ATM or paying for purchases with a card in a store or cafe;
  • check the ATM before use for any suspicious overlays on the keyboard or card reader;
  • do not use the card to pay in dubious online stores (fraudsters often launch decoy sites that look very similar to well-known resources);
  • set card limits for cash withdrawals and for non-cash payments;
  • It’s better to have a separate card for online payments and store a small amount of money on it;
  • If the phone number to which the mobile bank is connected, an SMS notification is linked, changes, then you must immediately notify the bank about this.
